What Information We Collect
Information that you provide
When you register a Temu account in Georgia, we do not utilize facial recognition technology to verify your identity, and therefore Our Face Verification Processing notice is not applicable to you.
Legal Basis
We rely on the following legal bases to process personal data – the applicable legal basis depends on the specific purpose for which personal data is used:
Performance of a contract. We process your personal data as necessary to perform the contracts you enter into with us (such as the Temu Seller Services Agreement) when you register for, access or use our Service. This includes when we use your personal data to develop, support, and provide the Service, allowing you to create, maintain and manage your account and use the Service. If you are a representative of a legal entity (or a beneficial owner), we rely on our legitimate business interests and/or legal obligations as stated below when processing your personal data for the purposes noted in the “How and Why We Process Your Information” section.
Legitimate interests. We use your personal data where necessary for the purposes of the legitimate interests pursued by us or third parties, provided these interests are not outweighed by your interests or fundamental rights and freedoms. This includes when we optimize features, analyse performance metrics, fix errors, improve the Service and our business, communicate with you, and detect and prevent fraud and abuse in order to protect the security of our customers, Sellers, ourselves, or others.
Your consent. We process your personal data when you have given us your prior consent for a specific purpose that we communicate to you. When you consent to our processing your personal data for a specified purpose, you may withdraw your consent at any time, and we will stop processing your data for that purpose. Your withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal (please note, however, that we may still be entitled to process your personal data if we have another legal basis other than consent for doing so).
Compliance with a legal obligation. We may use your personal data where it is necessary for compliance purposes and to comply with the applicable laws, lawful requests, and legal processes (e.g., responding to subpoenas or requests from government or regulatory authorities, or where there is a mandatory duty to report criminal offences); to protect our, your, and others’ rights, privacy, safety, or property (including the establishment, exercise or defence of legal claims); to audit internal processes to ensure compliance with legal and contractual requirements and our internal policies; to enforce the terms and conditions that govern the Service; to prevent, identify, investigate, and deter fraudulent, harmful, unauthorised, unethical, or illegal activities, including cyberattacks and identity theft.

Your Privacy Rights
In addition to the rights provided in the “Your Rights and Choices” section of the Privacy Policy, you have the following rights and any additional rights granted by applicable law, which can be exercised in accordance with applicable law:
Right to receive information on the processing of data and the right to access and to obtain a copy. You have the right to obtain confirmation as to whether or not data concerning you are being processed and, if requested by you, certain information about the processing. You also have the right to access personal data concerning you and obtain a copy of such data;
Right to the rectification, update and completion of data. You have the right to request to rectify, update and/or complete erroneous, inaccurate and/or incomplete data concerning you;
Right to the termination of the processing, erasure or destruction of data. You have the right to request to terminate the processing of (including profiling, if applicable), erase or destroy data concerning you. We will complete such request unless (i) other legal basis under applicable law exists; (ii) data are processed for the purposes of substantiating a legal claim or a statement of defence; (iii) the processing of data is necessary for the exercise of the right of freedom of expression or information; and/or (iv) data are processed for archiving purposes in the public interest as provided for by applicable law, for scientific or historical research purposes or statistical purposes, and the exercise of such right would render impossible or substantially impair the achievement of the purposes of the processing;
Right to the blocking of data. You have the right to request to block data if any of the following circumstances exists: (i) the authenticity or accuracy of the data is contested by you; (ii) the processing of the data is unlawful, but you oppose the erasure of the data and request the blocking of the data; (iii) the data are no longer needed for the purposes of the processing, but you need them to lodge a complaint/claim; (iv) you request the termination of the processing, erasure or destruction of the data and this request is being considered; and/or (v) there is a need to retain the data for use as evidence;
Right to the transmission of data. In case you consent to the processing of data concerning you for one or more specific purposes, data processing is necessary for the performance of a contract entered into with you or to enter into a contract at your request, and/or you have given written consent to the processing of the special category data as defined under applicable law for one or more specific purposes (if applicable), if technically feasible, you have the right to receive the data concerning you that you have provided to us in a structured, commonly used, and machine-readable format, or to request the transfer of such data to another data controller;
Right to not be subject to automated individual decision-making. You have the right not to be subject to a decision based solely on automated processing, including profiling, if applicable, which produces legal or similarly significant effects concerning you, except where the decision based on profiling: (i) is based on your explicit consent; (ii) is necessary for entering into or performing a contract between you and us; and/or (iii) is provided for by applicable law or by a subordinate normative act issued within the powers delegated on the basis of the applicable law. Temu does not make decisions based solely on automated processing that produce a legal effect or that similarly significantly affect individuals.
Right to withdraw consent. You have the right to withdraw consent at any time and without explanation. In such case, the processing of the data shall be terminated, and/or the processed data shall be erased or destroyed, according to your request, provided that no other legal basis for the processing exists. Before withdrawing consent, you shall have the right to request and receive from us information on the possible consequences of withdrawing the consent;
Right to appeal. You have the right to apply to the State Audit Office of Georgia, to a court and/or a superior administrative body in accordance with procedures established by applicable law if your rights as provided for and the rules established by applicable law are violated.
These rights (except for the right to appeal) can be restricted if the exercise of these rights may jeopardise, for example, national security, information security and cyber security and/or defence interests; public safety interests; and/or the protection of the rights and freedoms, including freedom of expression, of you and others. Restrictions of the rights are included in the Law of Georgia on Personal Data Protection and other applicable laws.
